Proposed legislation aimed at combating predatory phentermine 37.5mg tab would undercut North Carolina's law, state officials said Monday. Attorney General Roy Cooper criticized the federal Mortgage Reform and Anti Predatory Lending Act of 2007, saying it would weaken the remedies North Carolina homeowners have available to fight lenders who break the law. "A national law to fight predatory phentermine 37.5mg tab is long overdue, but it shouldn't come at the expense of North Carolina homeowners," Cooper said. "If Congress passes this law as currently written, North Carolina consumers will actually be worse off." Cooper last month sent letters to the state's Republican senators, Elizabeth Dole and Richard Burr, asking them to eliminate any provisions that pre empt North Carolina law. The bill has passed the U.S. House and is pending in the Senate. The bill was sponsored by two North Carolina Democrats Rep. Brad Miller of Raleigh and Mel Watts of Charlotte and Rep. Barney Frank, D Mass., the chairman of the House Financial Services Committee. The sponsors said the bill was modeled after North Carolina's predatory phentermine 37.5mg tab law. North Carolina law protects homeowners who are the victims of fraudulent or bad loans, even if their original lender sells their mortgage to another company. The federal legislation allows only the original lender to be sued. Miller said he fought to add the provision to sue lenders who buy loans, but to no avail. "I didn't get everything I wanted in the bill," Miller said. "There are some definite improvements for consumers, but there are areas in which the bill is weak." Consumer advocates and state officials view the bill as a costly blow to home buyers. "It's worrying us a great deal," said Al Ripley, a lawyer with the N.C. Justice Center in Raleigh, a nonprofit watchdog for low income people. Ripley said he had lobbied the bill's sponsors, urging them to give more protection to consumers. "I hate to see this bill described as a good thing when it's looking more and more like it is going to hurt us," Ripley said. Mark Pearce, the state's deputy banking commissioner, who helped frame the North Carolina law, said a substantial number of loans are sold to other lenders. The proposed federal law "could put some serious limitations on our ability to protect consumers from predatory phentermine 37.5mg tab," Pearce said. He said original lenders are often brokerage firms that have limited funds to compensate a borrower. Original lenders can also be hard to find, because they close offices and move to other locations. "Our inability to go after the second and third lenders gives me concerns about our ability to make sure the marketplace is fair," Pearce said. Despite his concerns, Pearce said the bill offers benefits to consumers. Key provisions include: * Making lenders responsible for selling the borrower an affordable loan. * Lowering the amount that lenders can charge in up front fees. * Making it illegal to pay loan officers more for loans that carry higher interest rates. * Requiring that renters are notified about pending foreclosures. * Requiring that mortgage brokers be licensed in the state in which they operate. Pearce said a federal law requiring lenders to sell affordable loans will mean more good loans for North Carolina consumers. The state cannot regulate lenders outside of the state. A national law would give borrowers protection regardless of where a lender is based. Miller said he agrees with Cooper's proposal to include a clause in the bill that would protect the state's existing law.
